Dear Friends,

I have some important F-1 visa and immigration questions, hope someone could help me and provide information or refer me a good immigration lawyer.

I graduated from United States(Bachelor's degree) , When I went to USA, I had always maintained my student status, but during the last year I was out of status, because I didn't extend my I-20, program of study. After sometime I came to know from my friend about that, I went to see International advisor and he told me I was not in my status. It was International Advisor fault too not telling me that I had to extend. Because I thought as long I was always maintaining my full status, taking full load of classes, I am fine. He suggested me to either leave the country and apply for visa from home country and or apply for reinstatement with INS. I thought I would better apply for visa from my home country.I graduated but had to live as out of status in USA for 2 years. I came to Nepal and currently working here. But now I want to apply for my graduate program for January semester.It has been a year now I am in Nepal.
Thus my questions to you, will I have trouble getting the visa if they came to know my past status? What status will I have there in the Sevis record? If I get the visa will I have trouble in immigration entry? I am eagerly and anxiously waiting for your suggestion, advice and information. Becuase I want to apply for visa only knowing the facts properly . Hoping to hear from you soon

None of us knows the result because US Embassy employees in Nepal depends on their mood in getting visa. My Suggestions is Since you are already in nepal and planning to apply for visa anyway, DO IT and let us know what happened.

I don't think you will have any issues with immigration but they might create some issues there at the US embassy. But, if you could explain them the situation, you should be okay (if they are in the good mood) as you never know who do they deny for what reason. Good luck to you!
