i graduated last month mid may. i have not yet recieved my opt card, however i recieved my h1b approval. i will have the status change from the 1st of oct what should i do untill then, do i have to go back to nepal?? so am i allowed to stay here till then????plzzzzzz help.

Enigma, What is your current status? If you graduated one month back and havent received your OPT yet, you have one more month to do something to maintain your status. Did you apply for OPT at all? If you did, you can check with USCIS and see whats your status. If you are not getting your OPT anyway, you need to do something within next one month to make sure you are still in status (you have a period of 60 days to do something about your status..in your case - 60 days from the time you graduated from your school).. From what I understand about your case, you can either go back to nepal and come after October, or you can enroll somewhere and get a I20 which will give you a F1 status. If you want to go for the second option, there are places like KAPLAN that provide you I20 if you enroll in their GMAT/GRE prep classes. Hope this will help a bit.

yes i did apply for opt 60 days before my grad. if i get admitted someweher will that not effect my h1 status?

your H1 will be effective only from October. technically you dont have a H1 so far. If you enroll somewhere to get a I20, it will not affect your H1 at all. I did the same thing some time back (after my OPT expired). before you enroll in any schools/institutions, I would suggest you to check with USCIS regarding the status of your OPT (you can also talk to your INTL student advisor and see what he/she says). It seems that you still have about a month. So take your time, find out more about the status of your OPT and then if that doesnt seem to work enroll somewhere. But dont wait too long. You will need time to talk to schools. they will ask for soem time to process ur applciations, transfer your sevis etc,....good luck.

Enigma, You don't have to worry about anything. I have friends who faced the same problem. This is what you have to do. Wait for 45-90 days or whatever time they have given you on your reciept. If you still don't get your OPT then GO TO YOUR LOCAL INS office and tell them the situation. Show them your receipt. They will issue you an OPT card. I am NOT making this up, believe me. The rule of USCIS is- once you have applied for anything and you have recieved a notice saying that it will be mailed to you within such and such days then you are SAFE. NO need to worry about 60 days crap. DO AS I SAY.
