 H1-B Transfer Question

I just went to Nepal few months back on H1-B and I have valid H1 stamp until Dec 2009. I left company A about 1.5 months back. Now I got a new job with company B which is willing to transfer H1. Company B's lawyer says I have to leave USA before I can start work. They have advised me to goto Canada and do a re-enter. Has anyone experienced this problem?

Is it because I was jobless for 1.5 months that Company B is asking me to leave country before I can officially start my new job? Your suggestions are greatly appreciated.
