husband came to US on F1 and still maintaining the same status. wife applied F2, rejected. Re-applied to attend graduation, rejected. Now, applied F1 to do MBA. All the documents are good. alltogether, 77K in bank. good enought to support all the academic expenses.
But, visa rejected.
and the reason was:
i) wife want to comeover to see husband
ii) she may not study.
i don't know the next step. what u guys think. i heard in the case of UK visa, we may take some legal action. how about US?
for me, both reason does not make sense.
i) no wonder wife and husband would like/love to stay together
ii) academically she is fine and she got the acceptance letter from the Univerisity for MBA.
What u guys think????????
Pls advice about the next step

hmm, really tricky situation then.
try to melt down the consular with some emotional playing.
Meanwhile ,
the concern of the consular must had been your;s hubby;s educational credentials,
ask him to attend an university and maintain good grades, and reapply and emotionally try to convinve the consular.
Real smart ppl take MBA, did you take an GMAT for it? if not I think u need to do it when you apply next time
How about TOEFL and your undergrad credentials . Make sure that you can convince the consular that u r going to be serious student.
Go through a mock-up interview process

Normally they do not reject if you have a TA (Teaching Assistantship) or an RA ( Research Assistanship). These credentials you will achieve in your masters degree. It becomes harder if you are an undergrad. So my only suggestion for you is let her apply after you joined masters and after you get a TA/RA or if she has good credentials and shows good intent of studying in United states to the counselor, then i dont think she would be stopped from getting her visa to US. i hope this helps!!

BRO,There is one more way you can try. However, there is no gurantee....but I have seen some positive responsesin cases.....go to your US Senator's/Representative's office and explain them every thing. Even though you're a foreigner they have to/will help you out because you pay your college tuition fees and living expenseand every thing associated with it--basically prooving the fact that you're the state's resident--at leasttemporary. Like someone suggested above, make a nice and emotional story based on your true incident and appealat their office. They will forward the case to the Senator in DC, from where the appeal will go to the US Enbassy in Kathmandu. The Embassy in KTM will respond back to the Senator's office with an explanationindicating why they rejected (i guess u already have it, but they will elaborate more), and what do youneed to do (submit additional documents or ways) in order to be able to get the visa. In addition to this, you have to be able to convince the Senator's office that your wife really wants to pursue a higher degree and that both of you will return back to Nepal after completing your studies (you have to gather diffreasons to support this theory though---like properties, economic, financial, cultural ties with Nepal; emotional tieslike your parents are there and need to be taken care etc ----just whatever you can bring in that makes sense to them).If you do this, the Senator's office will also write a recommendation letter on your behalf. When they hear back from the Embassy, they will contact you and explain you the situation. If you/ your wife submit/s all thingsthat the Embassy has asked for along with the senator's letter, your wife might be issued a Visa. However, like i said above,there is no guarantee on this either......but of course you will get to know what documents/things you need to submit and you willhave the Senator's letter, which will have a big plus point.....and the Senator's office will let you knowbases on the response from the Embassy what chances your wife has if she reapplies. But be sure to have a strong realistic story based on all facts when you go to the Senator's Office.All the best bro to you and to your wife.Happy Tihar!

ek@l, Don't get frustrated by 3 rejects. Personally I know one guy whose visa is rejected 5 times, sound unbelievable. But he didn't stop going for interview and eventually he was given visa probably consular thought that guy won't give up. Sometimes, your number of attempts gives you an advantage rather than disadvantage (provided you have all the documents). And Ek@l you have to remember one thing, you being in US infact makes your case of wife stronger than weaker depending upon how your wife faced the interview. When I applied overseas my parents were already in that country, but I didnot present myself as if I was going to see the parents. Infact when they asked me why do i want to go in their country , my answer was mostly related to my subject of study and not related to parents at all. It all depends on your wife..........here are tips......... a. Your wife shouldn't appear as if she is coming to see you. She should show how important that study is for her. b. Show consular that she is serious about her study. Show GRE, GMAT , TOEFL, TA, University accommodation and other documents. Show everything possible that shows she is serious about her study. c. Don't give up trying. it is just matter of time before they allow.

ek@l,
I am coming back Nepal soon. Finally, I got a PhD in full assistantship. My wife visa was rejected once in OPT but now I am taking risk to go Ktm (quiting this job, really good). My visa has also expired and we both husband and wife are trying at this time but still I am here in USA and waiting my new I20. I don't know, what would be the final result.
So sorry for your story.
