Hey Everyone, I need your expert opinion on my current situation which goes like this. My uncle applied for asylum some time ago and now his application has been approved. He's in the process of filing for a Green Card. Since he has not seen his mom for the past 6 years, he wants her (65 year old) to be here in US for this Dashai. Except the approved asylee status of my uncle (which I consider not so good from an Embassy standpoint, has couple of convenient stores and has been paying taxes all along), his mom however has all the documents needed for Visa back in Nepal (all credible and valid ones). So my question is a two part question I guess. First, can my uncle send an invitation letter for his mom? If not, end of story but if he can, what do you all think should be included and/or omitted from the invitation letter? Please share your thoughts. Thank you for your time. Regards, MySweetLord

I think it is better if your uncle start the process for visa once he actually gets his Green card. The law says that once your asylum is approved you can only file for Green card (Permanent Residence) after 1 year. And it takes about 3-4 months to get Green card if all your information is correct. So, I suggest him to wait. Or else he can apply for an emergency travel document to go to India and meet his mother there instead.
