Hi to all

Here's the situation.
I remained in the US for several years maintaining my f-1 status.
Since jan 2010,however, I have been out of status. Stayed in the US
for over a year illegally and right now I'm in Nepal.

Now I'm thinking of reentering the US as a regular f-1 student with a new
I-20 from a different school other than the one that I last attented.
Basically I'm following the same procedure as any regular student would
follow to apply for visa and enter the US under f-1 status.

Provided I get my visa at the US Embassy in kathmandu,
Would I be allowed to reenter the US at the port of entry?
Or is there simply no way to get back to the US with my situation?
How would my case be treated by the immigration officers there?

Comments appreciated pertaining to my query.

lightspeed

What I've heard is that if you are out of status for up to 6 months you will be banned for 3 years from entering US and if you cross 6 months you will be banned for 10 years. I know somebody who was in similar situation. He went back home and applied for visa. He had some genuine reason (due to the misake of the officer at POE) so the visa officer  recommended to department of homeland security or USCIS (I'm not sure) himself for the waiver so he got the waiver and came back. I'm not trying to discourage you, but to me it seems you are in a difficult situation unless you give some credible reason to the officer at the embassy.

Good Luck

Sparty

You will be flagged during the interview. Theyll simply take ur 10000 rs and tell you that you csnnot apply for 10 years because of overstay. I had a relative go through same situation.

Lightspeed Bro,

You Fu(ked it up dude. There's no way they can issue you a visa if the consular wants to keep his/her job. I'm assuming you've already had your degree so better try Aus or UK. US ain't what it used to be. Good Luck Bro!
