My consultancy has filed my H1B through fraudulent system and they cannot be contacted . Not responding Nepali owned should I get a lawyer ?

definitely lawyer up n try to get the best immigration attorney in the job because if its under 212(a) (6)(C)(i) its lifelong ban to enter the US , not even waiver . its getting intense these days .

Ram bhakta I got the job desi style fake resume and I don’t know if I should go to work on Monday . What will my company do to me if I get a lawyer , the recruiter and the whole team who ran the consultancy have dissapeared , I don’t think I will be paid either now , should I apply for masters program , I will lose my status now, Hell has broken lose in my life suddenly.

not a legal advice but i would not start my payroll with a fake vanished company that is already or likely to be black listed .

an indian coworker from my previous job now is in similar trouble . some few years back, while on OPT , a NJ based desi company ( now blacklisted ) had used some fake documents to get job for him and hundreds others.

now coming this far, working in a reputed company ,he gets visa denied citing mistake made by a desi consultancy years ago . Indians get in this kinda trouble all day because unlike us their pathway to green card is 100 years long .

i would hv immediately abandon h1b and gone back to tps or school . immigration attorneys ( better ones) are expensive as hell.

I asked Avvo and the attorneys there told me I could sue the consultancy for ruining my H1B . It’s a NOIR which means my H1B is not in existence anymore , How can I change my status now ? I have to reapply for a visa leaving the country . They have business insurance so I want to sue them and get some money from this bastards , there probably are more like me . Anyone ever sued these body shopping IT consultancies before ?

Rajan you can share here pls I want to get other people’s view on this situation , deep shit situation , how to fight NOIR , my H1B was accepted in 2022 now I am out of status . For multiple filing by my consultancy , they were still paying me until last week should I go to work ?

I am totally in support of you. I was also in H1B at one time, but then I had to go back to school because I was laid off during when the economy was really bad. It is not that good either now. Well. At that time, it was easy, wrote a letter to USCIS, why I would want to go back to school and they replied affirmatively in 3 months and then stamped the new I-20 from another school and the transition from H1B to F1 was made.
Your case is different now. Is there like a grace period of 60-90 days (?) until you make the transition to school? I am not quite sure how it works here in your case. Can you resign voluntarily? Can this step help?
I was totally unaware of what is going on in the present world. See after you cross all those rivers and bridges, you tend to forget where you came from. Now there are newer worries and stresses taking a lot of my time. But anyway, now I am knowing all that has happened with H1B visas.
In the mean time, I ran into this video regarding H1B fraud that people are talking about. You might have seen this already.

Some lines that struck me in this video were:
Criminal law: Government has to prove this was done without WITH your knowledge. (thanks passinthru, it is WITH, yes!)
Immigration law: You have to prove that this was done without your knowledge.

So like Ram Bhakta said above, this fraud that happened without your knowledge, you have to keep fighting for yourself, later in future when you apply for another H1B or potential green card petition. I can always feel that a lot of people were innocent here, but because of some "too smart" people's vested motives, life does not become fair to innocent and unsuspecting ones.

Interesting.

I did not watch the video so forgive me if I am incorrect.

Although, I would think that the burden of proof lies on the "charging" party on the Criminal case (i.e. the government) while the burden of proof lies on the defendant on the Immigration case.

Summarized (and corrected) as:

Criminal law: Government has to prove this was done WITH your knowledge.
Immigration law: You have to prove that this was done WITHOUT your knowledge.

I may have heard it wrong. I was running through their conversation.
But yeah for that fraud, USCIS will always think you were a part of this fraud too "since you were working for them" and you will always have to fight for your innocence. As we all know how USCIS thinks.

You admitted heading to desi consultancy somewhere in NJ and obtaining GC through them . It has been almost 4-5 years old now i guess when underwear discovered how you acquired GC. You guys even argued about this matter here in sajha. Why do you have to fib now bennedict ??

USCIS is not stupid. 400,000 multiple registrations? When they are talking about all jobs loss and 1000s and 1000s of mass firing happening around every other day, some companies are looking for so many people to hire? Really? This is sick!
It was going fine until 2023 H1B visas, as we can all see.


Is this what it is coming to now? This is just killing the aspirations of many genuine people!!

Did Underwear and me argue?--> YES, but about something else, how he plays different characters in Sajha and cons people here.

Some options I discussed above, but you did not answer.
- Can you resign intentionally on your own accord? Go back to school? H1B is not in existence, but you are still an employee under your employer, with payroll running as you said, it means you are still with them, right?
- Can you change the employer? Transfer the H1B, but you do not have any H1B now. This one may be non-existent now. 
- Did you find out if you have any grace period to make the transition? To school or to another employer? Try to find this out with the lawyer. This is important thing to know, as we need time to make any kind of transition. Schools would not enroll you in one day itself, right? And currently it looks, going back to school is the only straw to save your status, unless you have some immediate US citizens in your family or some immediate H1B visa holders (spouse) who may add you as dependents. 

USCIS as it says, it is prosecuting the perpetrators, so it is understandable, your employer, recruiter are absconding, but I am not totally sure if USCIS will send somebody to apprehend you. By getting them arrested yourself, I am not sure how it would benefit you in that case? Are they going to give your some money back (you paid for filing H1B) or are they going to write some letter on your behalf that you did not know what was going on behind and that you are innocent?
Calling USCIS and asking what to do in your case might be aimless. as USCIS will never entertain these kind of queries and besides people at USCIS talk like some AI generated chat bots. (This is my experience.) Highly impersonal and secretive, they would not help you. Like Ram Bhakta said, getting a good lawyer and then getting your information right are the way to go.
Especially be clear about how much time you got left to move ahead.

bro seems to be in deep sh@t trouble , his h1 -to gc path is an uphill battle, unless he sues consultancy for fraudulent and wins it . the good part is, vanished consultancy barely appears in court and failure to appear court is immediate justice for the plaintiff . class action lawsuit is even better .

or go back school , marry a us citizen ( if possible) and you have a green card .

Hi H1Bseeker,
My consultancy was not paying me while I was on bench, my situation at that time was, I was on H1B but I was not being paid which means I was "Out of Status". I did lots of research on internet, I fortunately found "murthy.com", from that site's discussion, I figured out that complaining against my H1B petitioner in DOL (Department of Labor) was only option left for me. I had two options at that time,
1. Either stay in the US illegally
2. Or Filing complaint against my employer.
I was really traumatized by the situation, I can totally understand and feel the situation currently you are in,
I opted for the second option, because I worked really hard to get degree here, and I had no intention of staying here illegally,

I'm not sure if you are aware of the fact that DOL will provide you with lawyer (free of charge), and they will do the investigation. In my case, they did investigation and I got "Determination Letter" from DOL in 2-3 months of time I filed complaint, where they asked my Employer to pay all the unpaid H1B workers the back wage, with that letter I filed for change of status, then went back to Student status.
Though I did not get my back wages (which was not my primary intention), my only intention was to be back to status. I hope my experience will help you in anyway to move forward. Check the "Department of Labor, wage and hour division" https://www.dol.gov/agencies/whd and do some research of murthy.com or other sites.

Rajan9's case is something we can follow I believe, but you have to have really great level of patience and grit to get it closed.
First, I thought, how much fruitful it is to sue the consultancy when your status is in a complete limbo. But reading what Rajan did, it looks like there is a "hope".

I am sure the class action suit will follow from people who were genuinely bugged by the fraud, but it will take time for sure. This is really messed up.

And besides, where are these people (consultancies) gonna run? They have all their details, business address, contact phone, registration numbers, business tax id everything with USCIS/ IRS. They may not pick up calls or disappear from social media, but do you think all these companies who did 400,000 multiple registrations for H1B visa lottery are going to disappear from the soil of USA like in a month?
