I am going to nepal soon. I have to take H1B visa from nepal. What are the documents I have to take with me. Suggestions please.

Main documents are H1B approval form ( I forgot the name) that states the duration of your work permit, pay stubs from last 2 to three months, a letter from your employer stating that you are visiting you country for Xdays and you will be back to resume work.
These are the main documents. but you can take other documents such as, if you had filed tax previously, you can take those documents, your college I-20, transcript, diploma.

And once you have your visa, do not forget to get a "shram sukruti" work permit from "shram karyalaya" department of labor located in Teku.

Good luck. Don't worry too much. It is very easy to get visa for h1b. I just got asked one question and that was to describe my jub duties.

Do you want to come back after certain periods .. like they ask for F1 visa .. will u come back after studies and so on ??

Who says one has to go to Nepal in order to get H1 B visa? Unless if you have H1 B visa and you want to get stamp on your passport. Else you don't need to go Nepal just to get H1 B visa. My friend came US in B1 B2 and then to F1 and now he has been here in H1B since 4yrs.

Hurray :

One the form that you need to submit at Nabil bank, I think there is a question that says something like - do you have started working towards your immigrant status? - like to get your green card.

How did you handle that question?

For those, whose GC is in process, will that be a problem in your opinion?

I got confused here. I already approved H1B status here in US. I am going home and I should have to take stamp (visa) from US embassy.
Is there any confusing question on the form in nabil bank??
how long it will take to take appointment dates??

Appointment dates are available within 5-7 days these days.

There is this one question in the form that would force you to "reveal" your intent to permanently immigrate to US. I am not sure how the consular will take the answer for people in H1.

Since H1 is a dual-intent visa, I personally think it should be OK, however, wanted to know opinion of others who have been through the same process.

If you have H1B visa but don't have H1B visa stamped on your PP (which you need to have while coming back and the one which you have H1B approval I94 that you can not use as VISA. In the approval it clearly says “This form is not a visa nor may it be used in place of a visa that means you need to have stamped on your PP) then go to nearest country (people have started going to Bahamas to get stamped on there PP) so that you don't need not worry while coming back. Else you will have to go to US embassy to get stamped which most of us try to avoid the tension (you never know whether you are going to get stamped or not!) If I were in your place I would go to Bahamas and get H1B stamped on my PP and go to Nepal just to avoid the tension of going to US embassy which….I would not want to take a chance of rejection.

I am not sure which form you are talking about that has the question regarding greencard. I did not come across any such question.

But in case the counselor asks such question, you can always say that right now you are not sure about staying in US but have been thinking about further studies after gathering significant work experience. Do not worry, like someone above mentioned, H1 is a dual intent visa, so they are less likely to harass you like they would for F1 visa applicant.

Well, I am not sure about the documents to take to Shram Bhivag as I knew someone there, I got my done without any official documents, except for my passport, and H1b approval form.
They might ask you how many hours you work per week and how your work environment and working condition are. So on your letter from the employer, ask him/her to briefly write down that you work 40 hours (if that's the case) usually except for situation where more effort is required.

Important Docs:

1) I-797 (which states your h1b approval)
2) Employment Verification letter from your employer
3) Your Recent W2
4) Paystubs for last 3,4 months
5) Your previous I-20s
6) OPT card (if you have any)
7) The degrees and transcripts you have obtained in US
8) Your bank statement (if your spouse is accompanying you as dependent)
9) Any other docs that you think would be helpful

Please try to take all the above mentioned docs with you (just to be in the safe side). In my case though, the consular didnt even ask for my file which had all the above mentioned docs. He look into my original I-797 and started asking me about my job, the place that I am working at, my pay etc. It was more like a conversation than an interview and went very soomth. But I know few of my friends who have been asked to produce all the docs that I mentioned above. Dont panic, but do your proper homework and take all the docs - there is no harm in being extra cautious.

Regarding Shram Bivag, you have to take your stamped passport and a letter from your office stating that you have been employed there. Trust me, you will have to spend about 2,000 Nrs to make this "shram bivag" thing smooth - otherwise there are lot of hassels. You wil find some agents around the office who will help you.

I think they need to see the Form-I29. This is the main form for applying H1b. I was asked to show these when I went to mexico to get visa few years back.

How much we have to show in bank balance (at least) ..?? my wife also going to apply on same day with me .
Do they need any extra documents for spouse?

It depends. If your wife is already in US and if she already has H4 status, then you need to show her I-797 (her h4 approval notice issued by USCIS) along with your docs. But if she is applying directly from Nepal and has not been here in H4 status, then you need to produce your marriage certificate and other evidence of marriage(optional) to the consular. In any case, having a bank statement with balance enough to cover your dependent's expenses would help. There are no requirements for all of these, so I cant suggest you the dollar amount that you want to have in your bank statement - my guess is around 7,8 K would do. Again, these are all to be in the safer side - there are high chances that you may not be asked to produce any of these....

Hi kale_ko_chartikala and others,

I'll be going to the US embassy in a couple of months to get my H1 stamped. I've already started my Adjustment of status process. Do you forsee any issues during the interview process?

I'd love to hear from anyone who has been in similar predicament.

Don't worry about the question " do you have started working towards your immigrant status? - like to get your green card." because H1B is a dual intent visa. If you read on the website about h1b faq you see the following Q&A.

No, my company hasn't yet filed my GC. But I got my visa from Toronto Canada. It was pretty easy, they didn't ask any questions.
