Official, cop rob woman at TIA
KATHMANDU, DEC 18 - In a classic case of guardians of the law turning lawbreakers, an official at the Tribhuvan International Airport and a police constable robbed a woman returning from Saudi Arabia four weeks ago.
Sita Rai (name changed) on Sunday filed a complaint at the Ministry of Home Affairs (MoHA) against the duo and said the she was sexually abused and robbed of 9,500 riyal (around Rs 218,000).
The woman from Bhojpur has named constable Parshu Ram Basnet and senior non-gazetted officer at the Department of Immigrations at the TIA , Somnath Khanal, in her complaint.
While police on Sunday arrested Basnet and is at the Metropolitan Police Range, Hanumandhoka, presently, Khanal is at large.
Spokesperson at the police range DSP Dhiraj Pratap Singh said Basnet told the police that Khanal fled with the money.
Rai, who had gone to Saudi Arabia via India, landed at the TIA on the night of November 21. She was carrying a fake passport in the name of Bimala KC, Rai admitted in her complaint.
The official and the policeman at the TIA seized her belongings and travel documents on the pretext of a 'regular check,' Rai said.
According to her, Basnet then took her to the New Bus Park to drop her. She was, however, forced to spend a night with him at a local guest house, she said.
"He paid all the bills at the guest house and bought a bus ticket to Bhojpur for me and left," Rai says in her complaint. She realised only later that the official s actually stole her money. "He paid for everything to make sure that I didn't reach for my purse," she says.
MoHA Secretary Navin Kumar Ghimire has formed a panel led by joint secretary Bhola Siwakoti to look into the case.
"I received the complaint today and talked with the victim. We are not in a position to comment until the probe panel prepares the report," Ghimire said.

TIA Robbery: Ministry suspends immigration officials
KATHMANDU, DEC 25 - The Ministry of Home Affairs (MoHA) on Monday suspended two section officers and a senior non-gazetted officer for their involvement in the robbery case of a returnee female migrant at Tribhuvan International Airport. The ministry suspended Ram Prasad Koirala, Somnath Khanal and official Tika Pokharel of the Department of Immigration (DoI).
The two-month suspension comes a day after a joint-secretary-led probe panel submitted its final report to MoHA secretary Navin Ghimire. The report revealed that section officers Koirala and Pokharel, and senior non-gazetted officer Khanal at the Department of Immigration (DoI), along with constable Parshuram Basnet had financial motives behind the incident.
"We have officially initiated the process to punish the accused today. The suspension is only an initial action," said secretary Ghimire. Further actions will be based on the provisions for punishment inscribed in the Civil Servant Act 1993. Those found guilty can face five different types of punishment depending on the severity of their crime.
Sita Rai (name changed), 20, of Bhojpur lodged a complaint last Sunday with the MoHA against Khanal and Basnet, accusing them of robbing her of Rs 218,000 at TIA on the night of November 21. Her further accused constable Basnet of rape following the robbery. Rai was returning from Saudi Arabia after three years of employment under the passport of one Bimala KC of Parbat district. She had flown from India.
Coming across this illiterate migrant worker carrying someone else's passport, the officials had taken her to the immigration office in Kalikasthan. There, during interrogations, the officials robbed her of the cash. Basnet then volunteered to take her to a buspark where he allegedly raped her at the Solukhumbu Guest House. A recent health report has revealed that Rai is pregnant.
Although the prime accused, Khanal and Basnet, had named other officials, including the director general of the DoI, the probe panel failed to establish their connection with the incident. A source at the MoHA said that director general Suresh Adhikari and Director Ram Prasad Koirala should be held morally responsible for the crime.
A Kathmandu District Court bench remanded constable Basnet to police custody. According to Rai's lawyer, Basanta Basnet, various civil servant trade unions have been exerting pressure on the government to withdraw the suspension of the two section officers. He said that the withdrawal of their suspension would be "unacceptable." The government is preparing to bring about charges of fraud against the officers, said lawyer Basnet. He demanded that they also be charged with corruption and abuse of authority.

TIA is a money tree for the corrupt officers in Nepal. That is the reason most people want to work in Airport rather than any other place. Law and order in Nepal is just a joke. How can you expect to see a law and order from a system whose creators are itself corrupted. So stop asking for justice from government. Even if you get it it will be like as junkynfunky said म कुटे जस्तो गर्छु......त रोए जस्तो गर. The other irony is people in Nepal do not care and will not care unless such incidents happen to them. Even if they do for a while I bet this incidents will be remembered after a month. These incidents will be repeated again and again until people itself come to the front and punish those SOB. PS: oh wait what about government? well whatever. Government is just a joke anyway.

Shame on the government of Nepal that force people to come to streets for getting justice!
http://ekantipur.com/2012/12/27/top-story/young-activists-join-forces-for-rais-cause/364713.html
Young activists join forces for Rai's cause
KATHMANDU, DEC 27 - An amalgam of young activists has launched a public campaign demanding justice for a woman who was robbed and allegedly raped by a government employee.
Sita Rai , a 21-year old migrant worker , was robbed byimmigration officials upon her arrival from Saudi Arabia at the Tribhuvan International Airport and subsequently "raped" by a police constable.
The activists have launched campaign in the social media twitter and facebook and put up a petition online which internet users can download, fill out and send it to the prime minister's mail. Those without internet access can find a copy of the printed petition at Southgate of Singh Darbar on Friday. The filled out petitions will be handed over to the prime minister later on the day.
"We urge your office and the Home Ministry to immediately investigate this case and set an example of how violence against women will not be tolerated in Nepal," reads the petition.
"We urge you to use the vast resources at your disposal to call on every government and non-governmental body working on women's rights issues to find out what happened to Sita Nepali at TIA and pursue justice as required, to the full extent of the law," the petition has appealed to the public.
It further reads " Sita Rai has to get justice. By helping deliver that justice, you can also help deliver hope of a better Nepal to millions of Nepali women. To fail Sita Nepali would be to fail the nation."
The news of Sita's alleged robbery and rape came to light only when she lodged a complaint with the Home Ministry againstimmigration officials Ram Prasad Koirala, Somnath Khanal, Tika Pokharel Khanal and police constable Prasuram Basnet.
A medical test has revealed that Rai is pregnant.
The ministry suspended Koirala, Khanal and Pokharel after a joint-secretary-led probe panel found the officials guilty on Monday. A Kathmandu District Court bench remanded constable Basnet to police custody.
Although Basnet and Khanal are in the police costudy. Pokharel and Koirala are still absconding.

http://my.news.yahoo.com/raped-robbed-nepali-migrant-worker-overlooked-rights-group-054003857.html
Kathmandu (The Kathmandu Post/ANN) - Just as Nepal was wrapping up its "16 Days of Activism Against Gender Based Violence", the case of Sita Rai (name changed) hit the newsstands.
Rai, a 21-year old migrant worker, was robbed by immigration officials upon her arrival from Saudi Arabia at the Tribhuvan International Airport and subsequently "raped" by a police constable.
Despite the fact that her plight came to light on the heels of a national campaign against gender-based violence, human rights organisations and much of civil society have remained silent on the issue. Rai has been fighting the case on her own.
"I am disappointed that nobody stood by her. It is time for activists and rights organisations to ask themselves whether they only want to run donor driven programmes or respond to the needs of society," said women's rights activist Dr Arzu Rana Deuba.
She was quick to admit her own inaction and blamed it on the existing state of impunity in the country, referring to the government's blanket amnesty to perpetrators of human rights violations and wartime crimes.
"When such perpetrators are walking scot-free in society, people tend to be sceptical and ignore what is going on around them," she said.
Rai lodged a complaint with the Ministry of Home Affairs on December 16, many days after the incident had occurred.
She named police constable Parshuram Basnet and senior non-gazetted officer at the Department of Immigration (DoI) Somnath Khanal as the culprits.
A home ministry probe committee led by joint-secretary Bhola Shiwakoti uncovered the involvement of high-ranking officials.
However, only two section officers Ram Prasad Koirala and Tika Pokharel, along with Khanal, were found to be directly involved in swindling Rai.
The ministry suspended its three officials, while constable Basnet has been remanded to police custody for further investigations.
"This is the height of crime, where government officials rob and ultimately rape a service seeker," said UML leader Urmila Aryal.
"We have government and non-governmental institutions to speak for women. Why don't they speak for her?" asked Aryal, calling on the National Women's Commission (NWC) to take the lead in the absence of a parliament.
NWC member Mohana Ansari says that she only came to know about the case when the victim lodged a complaint with the commission on Monday.
"She is in a precarious situation. We are taking this case very seriously," she said.
Bishal Khanal of the National Human Rights Commission echoed Ansari. "We came to know about the case late. We have already taken up the issue as a complaint has already been registered," he said.
Lawyer and rights activist Mandira Sharma said she has been closely monitoring the case. Referring to the suspended officials, she argued that simple departmental action is not enough. "This is a criminal case that requires a thorough investigation," she said.
Given that it is state employees who robbed and raped an illiterate migrant worker, Sharma said that it is the state's crime against an individual.
Meanwhile, neighbouring India is currently aflame with protests over the brutal gang-rape of medical student in Delhi.
In Nepal, the silence is deafening. Rights organisations that are so quick to take up media-friendly cases have yet to comment, barely issuing a statement.
"When have we really ever spoken out in such a case?" asked activist Dr Renu Rajbhandari. "We seldom stand up for such causes."
Activists argued that the government has taken up the case now and they are waiting a verdict. "They [the perpetrators] should be doubly penalised," Deuba demanded.
Aryal pushed for life imprisonment, while Sharma asked for punishment under criminal law.
The activists are concerned for Rai and her physical and mental state. "I found her in a precarious situation. Can you imagine her state of mind?" asked Ansari.
Prime Minister Baburam Bhattarai had launched the national campaign with a televised address directing heads of security agencies and government bodies to take stern action against those found turning a deaf ear to complaints of gender-based violence.
"PM Bhattarai has made a mockery of his own promises of zero tolerance on violence against women," said Rajbhandari.

People like Urmila Aryal or Arzoo Deuba don't feel a bit of shame talking only about what others should have done and completely ignoring what they DIDN'T do. They are probably running a fat NGO for women's rights. This is where so many MUSHROOMED nepali organizations abroad could have stepped and the least they could have done is to give a statement demanding for the justice; they wouldn't do that because they're busy organizing dance parties and fashion shows. They probably think that they will never be cheated at the airport and become victims. What is NRN doing? Is it only about investments?

Activist, police scuffle in Baluwatar
KATHMANDU, DEC 28 -
An amalgam of young activists staged sit-in outside Prime Minister's official residence in Baluwatar demanding justice forSita Rai (name changed) who was robbed and allegedly rape d by a government employee.
Some 200 activists and commoners including CNN Hero Pushpa Basnet, among other representatives from the society, also turned up at Baluwatar to express solidarity with their campaign this morning. They have launched a campaign on Twitter and Facebook and put up a petition online to press the concerned authorities to book the guilty in accordance with the law.
The activists reached Baluwatar at 9 this morning to submit the petition report. However, police on duty did not allow them to trespass gate no.3 of the residence saying the area was 'No Entry' zone.
Prime Minister Baburam Bhattarai is also learnt to have declined to accept the petition.
It has been reported that the activists scuffled with police during the process of demonstration. Meanwhile, Prime Minister Bhattarai left for Pokhara to participate in one of the programmes during the protest.
Rai, a 21-year old migrant worker, was robbed by immigration officials upon her arrival from Saudi Arabia at the Tribhuvan International Airport and subsequently “ rape d” by a police constable.
On Thursday, the government had decided to dole out Rs 150,000 in compensation to Rai and to take stern action against the accused. However, the government so far has not taken any action against the two officers except suspending them for two months.
Sita, a native of Bhojpur, had lodged a complaint last Sunday at the Ministry of Home Affairs (MoHA) against Somnath Khanal, a first class senior non-gazetted officer and constable, Parshuram Basnet, accusing them of robbing her of Rs 218,000 at the airport on November 21.
Based on a report prepared by a joint secretary-led probe panel, the MoHA on Monday had suspended other section officers Ram Prasad Koirala and Tika Pokharel for their involvement in the case. Although Basnet and Khanal are in the police custody, two officers are still at large.
According to a ministry source, Koirala and Pokharel will face a fraud charge. The victim has pressed the government to charge the officers on a case of abuse of authority.

even though out of context topic but its quite educating
SINGAPORE: The 23-year-old girl, who put up a brave battle for life after she was gang-raped and brutally assaulted in a Delhi bus a fortnight ago that had created a nationwide outrage, died early on Saturday morning in a hospital here.
The girl, was admitted to the well-known multi-organ transplant facility Mount Elizabeth Hospital here on Thursday morning in an extremely critical condition, breathed her last at 4:45am (2:15am India time). She was earlier treated at the Safdarjung Hospital in Delhi.
"We are very sad to report that the patient passed away peacefully at 4.45am on 29 Dec 2012 (Singapore time)," the hospital's chief executive officer Dr Kelvin Loh said in a statement.
"Her family and officials from the High Commission of India were by her side. The Mount Elizabeth Hospital team of doctors, nurses and staff join her family in mourning her loss," the statement said.
The body has been moved to the mortuary in the Singapore General Hospital for completion of some formalities since she is a foreigner, sources said.
The family of the girl wants the body to be taken to India, Indian High Commissioner T C A Raghavan told reporters.
He said the girl, who was conscious, fought a brave battle till the end. She was brought to Singapore for being provided good medical treatment.
"The family is shattered by this development. At the same time, they realised that best possible medical attention was given. And in the end it was the scale of injuries that proved too much for the medical attention provided to her," the envoy said.
He said the final few hours was a trying time for the girl's family and they bore the entire process with a great deal of fortitude and courage.
Raghavan said the family has requested that their privacy be respected in their hour of grief.
The girl, accompanied by her parents, was was flown in an air ambulance in a critical condition on Wednesday night after her health had suffered a setback that morning in the Delhi hospital following a government decision over which experts were divided.
The six-hour journey itself was said to have been eventful with her blood pressure having dipped alarmingly.
The patient had remained in an extremely critical condition since admission to hospital in the morning of December 27 (Singapore time), the Mount Elizabeth hospital statement said.
"Despite all efforts by a team of eight specialists in Mount Elizabeth Hospital to keep her stable, her condition continued to deteriorate over these two days."
The hospital statement said "She had suffered from severe organ failure following serious injuries to her body and brain. She was courageous in fighting for her life for so long against the odds but the trauma to her body was too severe for her to overcome."
"We are humbled by the privilege of being tasked to care for her in her final struggle. We acknowledge the faith the Indian government and the patient's family have placed with us to ensure the best care possible was indeed provided to her at Mount Elizabeth Hospital," it said.
"We share their huge sadness at her passing and will work with the High Commission of India to provide the family support in this time of grief," said Dr Loh.
Late last night, the hospital said the condition of the rape victim had taken a "turn for the worse".
"As of 9pm (6:30pm IST), the patient's condition has taken a turn for the worse. Her vital signs are deteriorating with signs of severe organ failure," Loh had said in a statement.
"This is despite doctors fighting for her life including putting her on maximum artificial ventilation support, optimal antibiotic doses as well as stimulants which maximise her body's capability to fight infections," the CEO had said.
During her treatment in Safdarjung Hospital, the girl's condition had recorded several ups and downs. Three days after the attack, her gangrenous intestine was removed.
The bestial attack on the girl and her male friend in the bus had sparked off protests by students and women activists which took a violent turn in the capital last Saturday and Sunday.
Death for rapists was one of the demands of the protesters and the victim's demise could trigger fresh display of emotions on the streets.
One of the Delhi police constables Subhash Chand Tomar died in a government hospital on Tuesday and the post-mortem report had said that he had suffered a cardiac arrest from complications arising out of injuries on his chest and neck.
Shaken by the public outrage, government constituted a Commission of Inquiry into the incident and also set up a three-member Committee under former Supreme Court Chief Justice A S Anand to look into the possibility of rewriting the laws relating to aggravated sexual assault and enhancing penalty for it.

Gang-rape comes to light after 10 days
KATHMANDU, DEC 29 - A girl was gang-raped on December 19 at Aaurawani in Sunsari district.
According to police Inspector Suman Timilsina, she was raped by three men on her way back from a fair.
Timilsina said they were searching for the six suspects that the victim's family has named in a complaint. However, he refused to disclose the names lest the suspects should flee.
The case came to light only 10 days after the incident due to pressure from political parties and locals to cover it up. The victim's kin say the guilty are relatives of local political leaders. "Party leaders from the central to local levels offered us money to press that we forget the case," one of the victim's relatives said. "We want justice," he said.
The victim is in custody of a local nongovernmental organisation after treatment.
