How does it affect International students filing their tax return for their off campus work?
Which is the best way to file tax return?
DoeS IRS track their previous year status of tax return?

If you recived W2 from your off campus work, its advisable to file tax return. When you received a W2, a copy of it went to IRS. Some time in point you will be working in real office. Then may be you will be getting good salary. If you have not file tax return, then IRS will come after you as now IRS can make money. But right now IRS may think its not cost effective to come after delinquent with minimal income.

Go to IRS.gov. They have bunch of free sites that can use to file your tax returns. But morst of time only Federal is free and they charge few dollsrs for state.

Yes, especially because of Efiling, IRS is capable of tracking returns. Not only that they can use statistical tools to figure out variances for their audits.

Thanks highfly...As a student...let's say one had filed tax return as a citizen for working off campus coz he/she was not authorized to work as a student...if he/she is now is eligible to work and have a good salary and file tax return as legal worker..Can IRS track this variation of filing status?

I beleive you are in F1 visa. So, you are an exception for substantial presence test. This mean you have to file NR (Non resident) return.

But since you filed ordinary 1040 last year, you may wanna file ordinary 1040 this year and hope IRS never catches the mistake or you may wanna amend a 04 1040. I do not think IRS has anyways to find out the staus of the person filing the return. But I cannot gurantee on this one. I see lots of international students filing 1040 and not 1040 NR.

There is an exception to student where they can file 1040 instead of 1040 NR if a student resided in US as a student for more than 5 calendar years.

Hey nanu,
I don't think it's gonna make a big difference. Because it might take hundreds of years to track out every international record. But you can try taxact which does not ask you to enter info about resident or non-resident. It just asks most imp questions so you don't have to deal with that.

I have done twice and wasn't a problem or issue.

You need to file tax. Period.
How? Use 1040 NR or 1040 NR EASY.
Look all the documents such as W-2 and any scholarships or assistance you received from school. Check them if they are taxable.
Come up with the taxable income and pay taxes if you owe or ask for refund if your withholding was more than your taxable income.
Will the IRS come after you? Next time if your tax is one of the lucky one they audit a few every year, they will. Even not, you yourself have to be responsible and file taxes. If you have missed once, you can still file, if you owe them, then you have to pay penalty and some interest. If you get refund, no big deal, they will send you back.

That is what I feel, I actually dont know. ha ha. Actually, i need help doing my own taxes, ha ha.

yeha ako kato bhayo, tes ma bhar parchha. sufficent time pugya chha bhane, 1040 bharda pani huncha, suficent time ho bhane irs considers you as resident for tax purpose while for INS ofcourse not.

My understanding (based on substence) is that the form you use (1040 or 1040NR) does not matter until you are one of those in randomly sampled cases. IRS policy is that the random sampling can take place upto 3 years after you file. So guys, for anything you did before 2002, you are off the hook but not necessarily after that time. BUT, based on one of our university's Tax expert professor, less than 10% of random cases deal with people with incime below $40,000.

My advice, if you can save anything above 400$ , go for any filing that helps you if your incime is below $30,000

It doesnt have to be your tax expert guy saying. IRS doent care if you say that your tax expert in your school said that. Go and look on the IRS publication, they mention what percent for what income bracket will be audited each year. I dont know what three years you are talking about. Read the rules and if you dont understand there are interpretations, when you file after you read it, keep a copy of what you understand and on that case even if you did mistake its an honest mistake and it wont be considred fraud. But if you did what you hear or you Indra ko Bau Chandra says, that is not a valid reason and even if it correct you dont have a basis why you did that. Publications are available on IRS.GOV site dudes.

I HAD FILED IN 01 BUT IT'S BEEN A WHILE DIDN'T FILE. I NEARLY 10000-12000, I ASSUME N MY WIFE AROUND 8,0000-11,000. IS IT BETTER TO FILE JOINTLY OR SEPERATELY.

HAS THE TAX LAW CHANGED, I AM A FULL TIME STUDENT N MY WIFE PART TIME. PUTTING STUDENT AS OCCUPATION WILL HELP OR NOT. AROUND 18,000 JOINT INCOME'S TAX FILE WILL PAY US BACK OR WE HAVE TO PAY.
IF I HAVE TO GO TO TAX EXPERT FOR TAX FILE WHICH IS THE AFFORDABLE N NICE? IS HR BLOCK PRETTY GOOD
