Hello all,

I am an US citizen who has spent some time in Nepal. I am posting on this forum because I have an immigration question regarding a friend of mine who we will call "Mr. Magar". Mr. Magar came to the U.S. on a tourist visa 6-7 years ago and has been working off the books in the restaurant industry since that point. He uses his earnings to support his wife and three children in Nepal.
He recently called me because he hopes that I can sponsor his wife on a tourist visa (I assume B-2?) from Nepal. Once he has shown her how to get along here, he will return to Nepal. At that point, she will apply for political asylum of some type (due to the security situation in Nepal) and then she will be able to call him and their children to this country. They will then all be able to live here legally.
I empathize with his situation and I don't necessarily agree with my country's immigration policies, but I worry that this plan seems unlikely to be successful. He assures me that his 'mamako saathi' or someone was able to pull something like this off (and he himself is here via the tourist visa) but I didn't quite get the details. As I learned from my time in Nepal, I rarely understand the full story. Specific questions for the forum:

1. What is the feasibility that a married Nepali woman, who speaks little or no English, has few assets, and whose husband has already overstayed his visa in this country, will get tourist visa?

2. What should my role be in assistance? Would Mrs. Magar need a certificate of sponsorship (I-134) for her tourist visa? I am a grad student and my wife is a school teacher so we may not have the assets necessary to sponsor. I also worry about any legal ramifications if she decides to also overstay her visa. I have only met his wife once in Nepal, and I am will to help but I am not willing to lie on official documents.

3. Any advice for Mr. Magar? He seems caught in a trap: he wants to see his family but he can earn so much more here, and if he returns to Nepal, I think it is unlikely that he could ever get back here.

I am sure this guy is trying to fake his own story, there is no friend, and no US citizen involved in this story.
But i have a sympathy over his situation. Guys if you can help him??

It is hectic step but it works. Friend of mine had the same story. He came to the US in tourist visa and wanted to stay here because he found better opportunity than in Nepal. He literally had no status. His wife back in nepal in some way managed to come here and applied for asylum and got approved. She brought her family here later on.They are all here now.

Your role i assume would be to sponsor her to come visit you durging the period like Christmas, thanksgiving, or any opportunity that you put importance on.

THe documents you could send her would be
1. your tax return papers
2. property tax papers
3. your letter stating that you want to see her in the US for what reason(you must state her name, dob, passport number and address in nepal
4. THe letter of sponsorship that you will afford her trip here
5.the copy of your passport
6.the letter from your work( in the letter head what position you hold and what you do)
don't forget to let them mention how much you earn in the paper
7. any relevant documents that you hold strong position in the USA.
I guess, if you do this, lord will be happy to give some innocent nepalese an opportunity to come to the USA where she could meet her husband and get good life

Hey gbnc,

Thanks for information. I see some other posts about Nepalis seeking asylum which were helpful as well. Since I don't think Mrs. Magar has any specific reason way in which she is being persecuted in Nepal, I think being granted asylum is unlikely. If that is unlikely, then it would be a waste of money for the flight for her to come to the U.S. on a tourist visa. Thoughts?
