‘CJ must give public clarification’

KATHMANDU, June 25 - Law Minister Narendra Bikram Nemwang on Sunday said that the Chief Justice Dilip Kumar Paudel must publicly give clarification regarding his meeting with parties to sub judice cases at his official residence in Baluwatar, Kathmandu, at different times.
"The meetings have raised moral questions for the Chief Justice. So he must clarify in this regard clearly," Nemwang said, talking to the post. "In fact, judges must not meet any parties to pending cases, at their residence."

Nemwang was commenting on the Post news about the meeting between Chief Justice Paudel and defendants/plaintiffs at Baluwatar, the official residence of the Chief Justice.

In violation of national and international code of conduct for judges, the Chief Justice received at his residence Chairman of Rastriya Prajatantra Party (Nepal) Rabindra Nath Sharma, former minister Khum Bahadur Khadka and former police officer Kumar Koirala while their cases were pending in court.

Minister Nemwang, who is also the ex-officio member of the Judicial Council headed by Paudel, further said, "I will decide further steps after he gives his clarification publicly."

In the meantime, advocate Nandu Raj Acharya filed an application in the parliament secretariat, urging the parliament to initiate impeachment of the Chief Justice on grounds of breaching the code of conduct.

"The act of the CJ (meeting parties to sub judice cases) will erode citizens' faith in the judiciary, so such a person should not be allowed to remain in the post," the application reads.

Cartoon contemptuous: CJ

Meanwhile, Chief Justice Paudel on Sunday termed the cartoon published in the Saturday editions of the Post and Kantipur dailies as contemptuous. "As we were sitting for tea in the afternoon at his office, he (the CJ) picked up the papers and asked, 'Aren't these cartoons contemptuous?' " a Supreme Court justice quoted the Chief Justice as saying. The cartoon read thus: Uh-Uh,...uncomfortable... to give verdicts from this low chair. Have you got a 'brief-case'? ... for evaluation."

CJ flouts code of conduct

KATHMANDU, June 22 - Chief Justice Dilip Kumar Paudel has frequently met the parties to sub judice cases at his official residence at Baluwatar, in violation of national and international codes of conduct for judges.
Evidence obtained by The Kathmandu Post shows that the Chief Justice welcomed President of the Rastriya Prajatantra Party, Rabindra Nath Sharma, twice at his official quarters ahead of Special Court hearings in two cases concerning Sharma. The court gave a clean chit to Sharma on Wednesday.

"Yes I met him. I had asked for an appointment and he complied," Rabindra Nath Sharma said. When inquired about details, he responded, "Why are you asking me that?"

The evidence shows that the Chief Justice first received Sharma on March 6, three weeks ahead of a hearing in Sharma's case at the Special Court. The hearing was on March 28. The next meeting occurred on May 12, eight days before the final hearing in the Special Court case. Coincidently, the Chief Justice met Bhoop Dhoj Adhikari, chairman of the Special Court, at his residence two days after the meeting with Sharma.

Besides Sharma, the CJ also welcomed former minister Khum Bahadur Khadka and former Deputy Inspector General of Police Kumar Koirala at his official residence. Khadka and Koirala are facing cases at the Supreme Court. The evidence shows that Koirala met the Chief Justice on March 9, two days ahead of the hearing in his case.

The National Code of Conduct for Judges,1998 and the internationally accepted Bangalore Principles on Judicial Conduct 2002, guidelines intended to establish standards for the ethical conduct of judges, say that a judge should not meet parties to cases being considered in court.

The 19-point national code of conduct, endorsed by a national conference of judges in 1998, states under point number 14 that judges should not have any "dealing" with the parties to cases. "Dealing" also means meeting, says former Supreme Court justice Laxman Prasad Aryal, one of the architects of the code.

The Bangalore Principle is even more explicit on the issue. It says, "A judge shall not allow the use of the judge's residence by a member of the legal profession to receive clients or other members of the legal profession."

When asked whether a sitting Chief Justice can meet parties to sub judice cases, Kedar Nath Upadhyay, former chief justice of the Supreme Court, said "No."

Similarly, Judicial Council member Moti Kaji Sthapith said, "Generally speaking, a judge should not meet litigants if he knows the case is pending in court."

Likewise, lawyer-turned Speaker Subash Nembang said a judge should not meet the parties to cases. "Nowhere in the world do judges meet the parties to cases."

The existing laws are, however, silent about punishment of judges who breach the code of conduct. "It is a moral question. And the Judicial Council should take up this issue," said Aryal.

The Post's repeated attempts to get a comment from the Chief Justice failed. When it contacted his office at the Supreme Court, the Chief Justice's personal secretary, Surya Parajuli, said that the CJ didn't want to respond to queries.

Thyangboche, I guess u missed the main issues like CJ being accused of molestation of his own adopted daughter for 2-3 decades; sudden disapperance of accuser; CJ meeting with ILLEGALLY IRRESPONSIBLY with the culrpits just before the verdicti affecting the decision. It has nothing to do with jan aastha or ID crisis in my opinion. When CJ himself is a criminal, what more can we expect from our justice system. What is Constiuent Assembly or anything is going to make any change?

HoR should intitiate CJ’s impeachment: NBA prez
Kantipur Report

KATHMANDU, June 27 - Nepal Bar Association (NBA) President Biswa Kant Mainali on Sunday sought initiative from the interim legislature to proceed with impeachment against Chief Justice Dilip Kumar Paudel on the charge of flouting the code of conduct. "As it is a matter (impeachment) in the domain of the parliament, the parliament should proceed with the process of impeachment after investigating evidences," Mainali said.

Speaking at a talk program at Reporters' Club, Mainali, referring to national and international code of conduct of judges, added that no judge should meet parties to subjudice cases at an individual level. "And if s/he meets, s/he must be punished on the basis of the code of conduct."

Mainali's remarks were in response to a news report on breach of code of conduct for judges by the Chief Justice, published last Friday. The CJ had met RPP (Nepal) Chairman Rabindra Nath Sharma, former Minister Khum Bahadur Khadka and former police officer Kumar Koirala, whose cases were pending in the courts at the time of meeting at his official residence in Baluwatar, Kathmandu, in violation of national and international code of conduct for judges.

Similarly, lawyer-cum-parliamentarian Harihar Dahal sought clarification from the Chief Justice regarding the latter's breach of the code of conduct. "In a democracy, questions are raised but they should also be responded to. The CJ must respond to the news report. Even NBA should probe the code of conduct violation," Dahal said.

In the meantime, political leaders have said they will raise the code violation issue in parliament, which convenes on July 2. "It [code violation] is subject to impeachment. It is condemnable," Maoist leader Dinanath Sharma said.

He further informed that political parties are holding discussion on impeaching the Chief Justice.

Similarly, CPN-UML leader Pradip Gyawali said the CJ cannot remain silent in this regard. "Acquittals one after another from corruption charges by the Special Court has drawn the attention of our party. And the verdicts have defamed loktantra."

I don't know about internal disputes among them; but the accusations made against him are very serious, and the government is silently sleeping as usual. Other journalists are afraid to speak except in few blogs, and the Human Rights activists haven't spoken a word about the disappearance of the accuser.

Impeach Chief Justice

After series of disclosures, Chief Justice of Nepal, Mr. Dilip Kumar Poudel has lost moral ground to continue in his post. His vindictiveness towards editors and scribes for publishing news report on his sexual exploitation of his daughter has by now fully exposed him. .....

As a matter of fact, the JanaAstha news report has never mentioned that he has molested or sexually assaulted any lady official of the supremet court. It has never mentioned that after becoming Chief justice, Mr. Dilip Kumar bought piles of viagra to indulge in exploitative incest with his own daughter. It has never mentioned that Dilip Kumar was chief justice when he first assaulted his own daughter when she was merely 13 years old ....

On the other hand, The Kathmandu Post and Kantipur has categorically mentioned that chief justice met some accused in his own residence. Subsequent to these meetings, most of these accuseds were absolved of the charges against them. These news stories have clearly shown that actions of Dilip Kumar during these meetings and after these meetings pertain to one chief justice. The accused from Khum Bahadur Khadaka to Rabindra Nath Sharma met the chief jutice. When some accused meet the chief presiding officer,it can be conjectured that the meeting might have taken place to dilute the cases of prosecution against the accused. Similarly, one can even surmise that money might have changed hands during these meetings ....

And this is the same case in CD scandal, which clearly exposed the corrupt network in suprem court of Nepal, also. And in all these cases, where the chief justice is repeatedly mentioned as the one resorting to gross impractices, the supreme court has prefered to look the other way...
