 Travelling Between OPT to H1B period

Hi,

I am currently in OPT (valid till August 2007) and my H1B will begin from October 1st. Hence, I am planning to go to Nepal during August-September. To return, I will need to get my H1B visa stamp in KTM. Please advise/ share your experience if it is really OK to leave the country during this period? If yes, what could be the possible cause of visa denial. Thanks!

I'm goona have same situation next year, u can go now but u can only come back 10 days before october 1st. Get ur H1-b confirmed/approved before u leave..otherwise serious problem...

Hey Rosam, I am on the same condition..I am going to Nepal and come back with the stamp on my passport... I dont see any problem doing that...We need to go back to Nepal (or out of US) sooner or later to get it stamped any way.

Also What are the documents we would be needing for H1B?

there should not be any problem if your h1 is confirmed if not dont leave usa.Best thing would be to wait. i know lot of people who have had problems in past. if ur opt is expiring in august . you could take the 60 days extension for opt.but if you have already considered that than you could join some professional institutions like kaplan which will be cheap to maintain your f1 status until Oct. i think to go to Nepal should be your last option.

If u get the I 20 from Kaplan or any other institution, any other application that files to USCIS will be void. So H1 will not be approved. Thats what i heard...If u guys know much about it...please share yr ideas...

I finished my OPT last January and my H1 application was not approved last year. But this time it has been applied against Degree quota. To be in status I have joined KAPLAN course and have I20. Will I be denied just because of this? Prerit's information has scared me. Any suggestion from anybody?

If u have got I 20 before you applied for H1B u r alrite...if its other way i think that will be a problem...As far as i know, tha latest application voids previous application(s)...Correct me if i am wrong..

hey Prerit, where did u get that information from. H1 has nothing to do with ur joining kaplan thats just to maintain ur status so that u dont have immigration problem. By the way it doesnt matter were u join as long as u have an i-20 , you could have graduated from napal you still qualify to apply for the h1 with your degree and work experience under general quota . And guys plz do not leave Nepal during your OPT not atleast till ur h1 b is confirmed ,dont take that risk.

Everything I wanted to say, smyta said it already...he/she is very very rite...Yes ! pls do not leave US until your H1b is confirmed....you can go to Nepal anytime after you get your h1 or GC later... If you get stuck there with going leaving with opt only, end of story. It says in opt that not valid to re-enter US...CHeck that out !

I thought we were taslking about travelling after OPT expires and H1-B starts( Oct 1st). If we cannot maintain status between that period, we have to leave country. My idea was if H1 is already applied we cannot apply for I-20. It all goes through DHS(USCIS). I heard that the application for I-20 voids any other application on the past... Its not a legal advice....Its all i heard...Thanks guys
