what would happen, if we cannot get a job within 90 days of OPT......I can see loads of people talking about 90 days but none seems to have info on this question. Anyone with the informations/suggestions!!! Thanks...

Sparrow bro, thank you for ur informations. Are you sure? But when I talked to my advisor, she didn't say that we gonna "get out of status" and what she said to me is, if we cannot get job, they won't revoke our OPT but we must be active seeking job. And at the end, she told me that they just wanna keep track of ur employment and make sure that your knowledged is being utilized! what if we get back to college? Anyone with the right informations??? Thank you.....

Drifter Bro, here is what I have understood in this case. You need to be employed in the field of your study within 90 days after your OPT starts. However, if you are not able to find a subject related job within 90 days then your OPT gets canceled and then you have a grace period of 60 days to either join a school or to leave the country. If you are not able to fulfill either of those two requirements within the 60 day grace period then you become out of status. However, of you use your grace period before your OPT starts like I did, then you have to get a job within 90 days or get another I-20 within 90days. Hope this makes things clearer to you now. Got more questions? Shoot over here. I will answer if I can. And lastly, for the very worst case scenario, what you can do is you can do a volunteer work in your subject related area to maintain your OPT. That is what my international advisor told me. :-)

finding a major related job withing 90 days for a foreign student like like impossible. most companies are not even hiring now a days because of the crappy economy. some who are - are not willing to hire h1-bs. I wonder how many will get hired within 90 days. this also eliminates chances to join dhoti companies since it has to be your major related. so basically you're going to school for 4 years in America and doing everything right so you can graduate and be illegal?

jacksparrow, do the school inform us about out-of-status before they affected on us? Is it true as you mentioned that the grace period of 2 months after 90 days unemployment period and Opt cancelation?

npJHILKE, I am not sure where the school updates yoour info. It might be the school itself or USCIS website. I dont know at all. I am sure the school will definately let you know. And whatever I had written is true.

I agree with drifter Bro and would like to add what i know from my International Program Coordinator.What she says is It is for tracking of graduating student where are they going,what are they doing?r they utilizing their EAD?And,she knows its kinda difficult even for American to get job within 3 months..Good company advertises for job at least for 1 months,interviews goes for 1 month and taking references info back n background check take more than 1 month..then how can it be possible within 3 months?she added it is a new rule n nobody is sure about it.So,she told me to inform saying that I am actively seeking a job and provide new address if you move somewhere,All she needs is my current info every time..that's it..n I have to join school no later than 1 year if i don't get a job or even if i am from STEM. I got this info after my graduation and will again contact her and make sure what's going on these days with new OPT rule and shoot another thread..thanks.

NepGuyUs Bro...Thank you for dropping-by, your informations are appreciated hehee....Ani about the grace period (according to my fren's lawyer), there are 2 grace periods: 1st; 60 days grace period in which we have to get new I-20 or get into some instituition and 2nd; 90 (ho ki 150, i forgot) days grace period in which we have to start our semester....I think, DSO has a main role in our status, he/she is the one who report to the immigration thru SEVIS........check the ICE website.........

According to my knowledge, the rules go as follows:

1. Being unemployed for more than 90 days will make your OPT invalid. This means you are virtually out of status.

2. Virtually, because you still have 60 days of grace period to change the status.

3. This grace period is actually period for you to prepare for going back home :). However, you can go back to school, and thus maintain a valid F1 status.

4. However, there's no way you are going to be able to work, because this grace period is not for "revitalizing" your OPT (otherwise they wud have said 150 days instead of 90, as simple as that).

5. So, the best way is to find a job, somehow or go join a consultancy if you are an IT related graduate. Otherwise go back to school. Well, going back home isn't too bad of an idea :)

I talked to University of North Texas and University of Texas at Dallas (UTD) and DSO told me that..............if we are unemployed and not enrolled in school within that 3 months period, we are out of status. We do not have 2 months grace period. That is why I already joined the master. I raised this question so many times in Sajha past few months,  but very few replied. This is a very important issue and nobody has enough knowledge about it.

Please go and talk to your University as soon as possible. Join Master or some community college.
