Anybody has any idea how an undocumented Nepali person

who overstayed the visa can get legal status?

Any suggestions, referral, and/or help will be greatly appreciated.

Entered the USA with a tourist visa 6 yrs ago....got nobody to get help from...no suggestion to make IDs and driver license...so no driver license, no state ID...age is 40.......no professional education........have 3 children......paying their school fee by working here in a dollar store......cannot go back home because the children will be out of the school...you all know the situation in our country...no employment...a gas cylinder costs Rs. 1200....don't know what to do?...I am in a painful dilemma now....god bless me and people like me!!!

go back to nepal,

get a fake citizenship, fake passport and all the fake documents that u can get and apply for a visa again into the Unites States.

this actually is a nice idea

even if you are illegal in US, you are always legal in your motherland, so go to nepal and create a happy life there for yourself.

alternatively, if you are skilled and have enough points apply for canada immigration (i have heard that it could be finalized in a year). afterall canada is better than USA.

man, forget abou thsi country... save some money and go back. tell you what, my own experience... my mama ko chora started business 9 years ago and i came to study in usa.. over th eyears, he has bought 2 cars, a house and a profitable business.. while i spent 40 k from home , worked in gasstations, motels, cafeterias, went through massive pain of school and work and now i'm job less.. my brother bought a piece of land and over the years it tripled the value... he also bought some land in our village... the land's grew so much that it's crazy.. ovfer the years he has doubled tripled, 10 f0lded the investment and is financially secure. he married the girl of his choice and hey today's new year.. he's celebrating with his friends and family , bon fire and liquor and dance and everything.. and i'll be working in my night shift tonight...

   if you don't have papers, you end up working as slave in usa.. they know this ... thats why they are letting 22 millions stay illegal.. because they need slaves.... they can clean this 22 million anytime they want , but who's gonna work night shifts, on weekeds, on $5.5 per hour... 900 a month in a restaurant... man, it's not worth it...

 

one day you will be 45, 55, or 65, and let's say you have a green card... but then what's the point. . . . you'll lose your prime time cleaning , moping and listening crap in customer service jobs, under desi employers....

get back and try to do something man.. it's much much better.. you won't have a car , or hot water running all the time but you'll still have the dignity....

To be out of status is a real problem, you can not apply asylum. I am guessing you do not have earned skilled that will help to have a decent life in Nepal.
You did not let us know how you got to USA??? When you enter any place you must have backup plan for EXIT either the same door or back door in case if you have to EXIT.
The Best bet is marriage to citizens as other suggested.

Hi

I am here in Business Visa and my stay is only for 3 months. I spent 11 lakhs to get this visa and come here. Now its been already two months and I will be legal for only one month from now. I don't want to go back to Nepal right now, at least I have to earn what i have invested or even more. So guys is there any best idea that I can remain on status and earn. Any suggesstions highly appreciated.

nayasadak, are you sure out of status can not apply for political asylum? i don't think so . correct me.. i know some people who have done that. has the rule changed....i know people who are out of status and got their green cards from restaurants... i know a family who received a deportation letter and letter and now have green cards... so it's no impossible.. but luck has to do you a special favor...

No Tension

Don't worry and don't get frustrated. You can contact the above given attorney to get more information on this matter. People have been legal after being out of status and so, you can be one of them. So, contact an immigration attorney to get some ideas about the ways to do so.

Dhumus,

To remain in status for now, you can apply to extend your tourist visa. Tourist visas are usually extended for a six months's period. After that you can join a college and apply for a change of your status from a tourist to a student. If your status is changed, you can remain in status as long as you go college.

haha it's good idea to go to school at the age of 40. however mr/ms ignorant well wisher, who's gonna pay the tution ? guy's working at a dollar store and supporting his children back home....how can he pay for this tution with a dollar store sallary, pay for his expenses here and support his family back home ?

and please, don't say apply for financial aid or take loans? no he can't do that without being legal, ok....

Kalopani,

It's you who seems to be ignorant! The guy just wants to remain in status, which is ofcourse not free and certainly not easy. You can pour down other options, if you have, to suggest him to remain in status. His tourist visa will expire in a month and after filing for an extention might be extended for six months. After the six months, how can he maintain his status?????? Also, read the thread properly, this suggestion was for Dhumus, who is still in status and not for no tension bro, because it's sad that he can't opt for this option as he's already out of status. As far as age is concerned you must have seen people who are over 60 attending college and I have seen Nepalese people over 45 going to colleges--surely no harm to that!
