I had a car wreck and the other party was fault. The at fault party's insurance company has already accepted the liability. I missed some days of work because of the wreck. I am a student with F1 status and I work for CASH in a gas station. Since there is no record of me working for my employer, can I still file a loss of wage claim with the insurance company? And moreover since i work illegally, will that cause any problem ?

Please share your experiences or if you have any ideas.

Why only loss of wages for some days? Also claim money for mental depression due to accident, ask treatment for your pre existing medical issues. Common man, they pay for property damage and bodily injury. Don't get involved in sue, countersue unless reasonable justice is not served to you.

Furke, I am not sure if you are being sarcastic or if you really mean it. But I have suffered because of the accident and I am not sure if I should also file a loss of wage claim. My concern is will the insurance company be looking for any records using my ssn to verify if i work there. Because i work for cash and if they do so, they would not see any records of me working there. So may be I will get in trouble if they think I am trying to fraud them. Moreover, I am working illegally so I am little scared.

I work for a delivery company and one of the delivery guys was hit by a rental car, when he filed for loss of wage, the other party asked our company for the entire work history and average pay for the past three weeks. If they decide to go to the court then only you might need to deal with the law.

If you are working illegally than i would not suggest you to got for it. Yes, if hospital was involved than you could have got the money for your loss of working days without much hastle. But if you are not involved medically than i dont think it is that easy, pretty sure they will ask for more documents . It is just my point of view, does not mean this is right.

Deepak.. you can't do that since there is no record of you working. Even if you were working using SSN, then you need doctor's work leave to get the wage loss for the number of days recommended by doctor. You can file for bodily injury though... if you get a lawyer, he will charge you around 33% of the total claim settlement.
