One of my friends was caught by immigration police while travelling on train in PA. Heard that it was regular immigraiton raid and he is in immigration custody and they have not allowed him to make telephone calls. He is overstaying in US for the last 4 years. What will they do to him? Will he be deported? Or we can do bail? How much it will cost? Please help.

how did they know that he is illegal resident...was he working at some place which requires paper work and in what status he was?

I heard that it was an immigration check on train.  Sometimes they check randomly on bus and trains and people who dont have id got caught. Since he was illegal (overstayed), came here on tourist visa for a week 4 years back and stayed here illegally, he could not have produced any id infront of officers and got caught. Please advise guyz, how can we help him.

Yes this can happen. Few years ago INS raided a local bar, and detained everyone without an ID at the moment. Few Nepalese without IDs were caught as well. Some were released later when they proved their status and the illegals were prosecuted.

INS raided the bar that was popular among Hispanics. I wonder they did that to discourage illegal immigration. So yes they can ask for your ID anytime anywhere.

There is nothing that can be done. He should be allowed to make calls. He is gonna face deportation.

I am mentioning this cause it might be helpful to some ppls...as i have status check in my driving license...i was stopped by the cop while i was driving cause my status check was expired even i did not do any driving mistakes or speeding ..i had to extend my staying period n took care of status check...so just be careful guys n girls...rahul99.. i do not know what will happen now..i guess he is suppose to have visa for 5 years right or are u talking about 4 years after visa expired..tc

 i was stopped my a cop too and was asked to present my id they said the were just checking IDs.

Ice_cop, 5 year visa doesn't you can stay for 5 years. It's valid for 5-10 years but you can stay for about 6 months at a time unless you apply to extend the stay.

I think that guy had only business visa for few weeks and he overstayed for the last four years. I came to know that he is making calls to his friends now.

I was just wondering if that guy have any wayout.

from overseas or in a detention facility after the fact, there is
sometimes very little we can do to help. In some cases there are
mitigating circumstances that allow us to apply for waivers or other
relief, but it’s hard work and often expensive to try without any
guarantees of success.

1st of all he needs to get a lawyer,and he has to file to stop the deportation,,but he has to show his returnign to nepal will be danger to his life.since the condition of nepal,, lawless.. ask him to create some sort of story. and that same story has to be present from now on.
by the way where is he detained. what state? and where r u frm or he frm whauch state? do u have any nepali orgination. ask their help.
