Hi Mayagrg: While filing taxes, tax prepare has to be careful about EIC. If found not due-diligence IRS may be fined $510 each violation. I encountered with a client. She has 20 years old daughter and she is claiming as dependent child and a full time school. But she does not have 1098-T and No Educational Expenses to substantiate it . I took it as a red flag and she was not happy with little refund. Owner reviewed it , checked full time student and allowed $2200 EIC. The client was happy with fat check and my owner was happy with 445 tax filing fee. Please suggest: How to handle such cases?

That is not the question you khate : People are falsifying for EIC. TP did not have 1099 and any expense but claiming a child for full time student. Do you just do it as customer says or check for more documents?

If you are not satisfied, at least document that you have asked the question and put the note in file to cover your ass. If it is found that you knowingly filed the false return for the client, it's your license in line and you may face felony charges.

Chipre, I know what you mean. That's why you send cover letter to the client stating that return was prepared based on information provided. We, well at least I as a tax preparer don't feel that its our duty to audit the client. In his case, if client says that her daughter is a student then there's no point arguing.
