 EB-2 Vs. EB3

Hi Guys, My employer seems to be not interested to file my green card under EB-2 category. What is the difference in time for the Green Card Processing between EB2 and BE3 category? In which step the time difference occurs? Please share your knowledge.

EB2 has two options:
1) employment based -need to go through PERM
2) national interest waiver (NIW) - file I-140 and I-485 directly

EB3- has to go through PERM

To file under EB2 category, if you have a masters degree or a number of years of experience, you can. It is not necessary that you have to file under NIW. If you qualify, it is best to file under EB2 because it is faster.

Your employer must be a dhoti company. Those dhoti companies hardly file in EB2 because EB2 requires more detailed financial statement. Those dhotis are scared to show all their financial statements. Because they do lot of frauds such as not paying H1B when employees are not in projects and so on....They also do fraud and manipulation in their financial data to avoid taxes.

Watch out with those Dhoti Asss companies.

This mean "EB-1 Employment based" and EB-3 has three steps for green card processing viz. PERM, I-140, and I-485. My question is where does EB-2 category gets priority over EB-2 in term of time envolved in all three steps?

i do not know your qualification. but generally these are likely reason why any employer would not go for EB2....... .

unlike EB3, EB2 requirements are very stringent.
plus harder to justify unless you possess very selective skill sets.


for example:
EB2 => minimum qualification Masters.
a. its very hard to prove that all they require is Masters degree without any experience.
b. so they need to allow substitution i.e. Bachelors + 5 years. hence, it's once again difficult to justify.

now if you have Masters plus @ least 2 years of experience then employer would go for EB2
c. another problem is that not only you but your colleagues working in the same level should posses the minimum qualification. [ this again makes it difficult to comply ]

d. for EB2 experience gained in the same company is absolutely and completely worthless. cannot be used. you have to have attained/fulfilled those requirement before you joined the company.

hence, most of the employer refrain from EB2 unless they are absolutely sure that they comply these stringent requirement.

Yes, thapap is absolutely correct. Those all make bit tough. You know a lot. And hussain_khan is correct too. Indian don't want to go for EB2 due to their so many fraud activities.

One more thing,
Although I140 is the main step for consedering EB2 category, labor cert has to be determined for EB2 category.

Hmmmm..so EB3 seems to be "easier through" compared to EB2. But I am still wondering if anybody could share the break down of time involved in PERM, I-140, and I-480 under EB2 and EB3 category.

perm takes anywhere from 2 weeks to three months, i-140 takes anywhere from 6-8 months( present time line). and 485 if u are filling under eb 3 then may be 2-3 years( i dont know). but 485 for eb2 were current through out the year. ( not right now though). hopefully it gets current after september but u never know.

While in the green card process, when you can change the employer? Is it after PERM, or I-140? Also when will the work permit be issued?

only after u file 485 u can apply for ead.
