my spouse's visa (visiting and dependent) was rejected couple of times. now my H1-B rejected. so, i'm going back to school.

now i'm confused whether i should ask my spouse to apply F2 or F1 for MBA.

guys, pls suggest if any of you have gone through the similar situation .

if you have graduate assistantship, you can ask her to come here as a dependent.  however, if she is a good student and can do well in GMAT and TOEFL, applying as a F1 student is a good too.  But remember, if you both are in F1 and dont have assistantship to support education, it will be really tough.  i have seen people who have completed their education with support of spouse.  good luck.

i  might not get GA. from this semester onward i'll on F1 status for one more year. i have that feelings about F1 for both of us.US embassy might ask more papers to support our education and they might not consider the application especially when my spouse's visa was rejected. i'm going back to the university instead of commnunity college just to support my spouse's applicatioin.  i thought may be this is a positive sing so that visa officer could think, i'm just not maintaining the status.

i really appreciate if anybody advice me about F2 procedures. i heard about some medical supporting documets and something like that.

appreciate ur advice guys

So sorry to hear about the rejection of visa to your spouse. I also had the same problem a month ago. I am a graduate student with full assistantship. My family applied for visa second time and got it. The officials asked them for sufficient source of income and ties to go back to Nepal in the future. This time, they submitted the sufficient source of income(with supporting documents) and then they granted visa.
If you don't have GA, most probably they will not issue visa for your spouse. It is my experience. But you can choose the second option. Tell her to apply for MBA. She will definitely get visa, because most of the students get visa easily. So, good luck to you guys.
If you need any more assistance for this, you can tell me about that, I will try to remove your doubts to the best of my knowledge.

I didn't have any difficulty in getting my wife in US in F-2. Let me share my experience with you.

I married her when I went back to Nepal on F-1 visa. I came back to the US, and have International Student Coordinator prepare I-20 for her as a dependent.

Before the university issued her an I-20,  I had to furnish the bank balance as required by my school. I was in GA. I didn't really need to show any money, still showed some 4k at that time.  After I get the I-20 for her, I sent the I-20 with the letter addressing to the US Embassy to issue F-2 visa for my wife and documents (such as my I-20, transcripts, copies of passport and visa) to prove myself as a student here.

My wife was sponsored by her father, my family and she also had bank balance in her name. In every case, we showed more than 10 lakhs in each bank account. She didn't have any problem in getting F-2 in her first interview.

thanks guys.

alpha, i had sufficient fund on my account when we've applied F2. We applied visiting to attend my graduation and rejected too. i' have enough saving on  my US account these days. i'm gonna apply CPT from this semester itself to continue my job with the same employer where i'm working on my OPT these days. do you think this is worthy to do so? Even if i don't get GA, CPT also support some sort of tuition expenses. i've the copies of all pay check from August 2007.

Generally, they issue visa to the parents in attending your graduation ceremony, rather not to the spouse or others. Even if one has sufficient fund in the bank account, they want to see the source of income. That income should be verified by your, or wife's or parents' regular income. For example, I have some pieces of land in a city  in Nepal. I proved my bank balance with the sources that I am getting money regularly by leasing them. On the other hand, I presented the documents from the department from where I am getting salary as a GA.  If your OPT is fixed and you are getting a job offer from them, then definitely that should work. In this situation, you will be safe even if you  don't have GA.  So, go ahead. You will be done. Don't forget to inform me when your spouse gets visa. I am sure, she will get it this time. Thanks Alpha.

As I mention earlier, my OPT will expire within a month from now, I will join the school again. I've talked to my advisor regarding CPT to continue my job with the same employer where I am working on my OPT now.

I don't get GA at this point which is 100% sure. There is no way I can show the income from school. However, I can show the pay stuff from my employer as soon as i get CPT.
