I moved to an apartment few months back, the rent is pretty expensive for the area. The apartment is infested with mice and also I am in top floor, they have some wierd exhaust in the roof, that makes very loud noise when wind blows. It is very annoying. Management say they cant fix it, they tried exterminating the building several times but it is not helping. Is there any way I can break my lease, I need to get out . Anybody has ever been in such situation. Plz Help

'It is the law' that all the residential properties must be safe to live. If there are mice, molds, leaking, etc they must fix it for you. In case you want to move out because of expensive rent, Most lease agreements require that you give a 60 days notice prior your move out. If you choose to terminate your contract, talk to your manager if he/she has something good for you. Better u give a written notice of your move out asap. After 60 days, pay the reletting fee, usually a month's rent and you are done from there. Next time, inspect the property well before signing the lease and try to sign a least term lease like 6 months if possible. Good luck !!!

Thanks, no expensive rent is not a deal I thought since it was expensive it would be good. I signed a lease for 1 year, its been 4 months I moved in, Yes I talked to the management several times , gave them written notice. They tried but its beyond there reach, they r not ready to let me break my lease. The problem is they have my last month rent and deposit which is almost 4000, so how can I legally get out.

yep 60 days prior written notice wit a signature is wat u need to give them... by the way.. we broke our lease once ...back in november... we didnt pay a futi kaudi to the apartment office ... anyways ,, talk it out wit the manager or report to the management headquarter...the company that oversees this apartment chain

If you can stand strong then you can move out easily and receive back your deposit and the last month's rent. Just tell them strongly that you cannot resist the mice and the loud noise and want to move out instantly. And also tell them that you will take legal action if you are not allowed to leave. You can sue in the county stating that you are having hard time because of mice and the noise. There was similar case near my apt. They had bed bug problem and they broke the contract stating that problem and got their deposit back.

sue the property; you can do that because they did not tell that they were providing you an apartment infested with mice and bedbug or whatever. if they can provide another apartment without that problem you will be living there, otherwise leaving it soon. inform them about it.
